Employment law a deterrent to small business -- SFA

The Small Firms Association is calling for the urgent codification of employment law into a single act, and exemptions for small businesses from complying with overly burdensome regulations.

The call came during the SFA’s National Conference on Employment Law in Clontarf Castle, Dublin yesterday.

Commenting on the Action Plan for Jobs announced last week, SFA assistant director Avine McNally said there had been no consideration thus far in the Government’s plan of the practical difficulties facing small companies who wish to employ someone.

“Creating just one job means becoming familiar with a vast amount of different pieces of employment law, and is a huge deterrent to small business owners, who already have enough to do in running the other aspects of their business,” she said.

“As an employer, the 40 pieces legislation relating to employment matters must be dealt with, irrespective of whether the company employs 1 or 1,000 staff.

“Being on the wrong side of just one piece of legislation, however unwittingly, can exact a very high price on a small business!  It is essential that the Government makes the law and compliance with that law as easy as possible for small firms which it is relying on to create the jobs necessary to solve the unemployment crisis.  The codification of employment law into one Act is an essential starting point.”
