The editor of the Irish Times and one of its journalists have been ordered by the Supreme Court to pay a legal bill believed to be in the region of 600,000 resulting from a successful appeal the two made against a case taken by the Mahon Tribunal.
Even though the Mahon Tribunal lost the Supreme Court appeal, in what were described as “exceptional circumstances”, the Supreme Court ruled against the Irish Times on costs, saying the Tribunal should recover the cost of both the Supreme Court actions and a previous High Court action.
The source of the Mahon Tribunal’s case was an article by journalist Colm Keena published in the Irish Times in September 2006 about financial payments made to former taoiseach Bertie Ahern. The tribunal had sought a court order for Keena to appear before it to answer questions relating to his source for the story.
Irish Times editor Geraldine Kennedy said she was disappointed by the Supreme Court’s decision.
